Frequently asked questions
Who must have a whistleblowing channel in Spain?
Spanish Law 2/2023 applies to companies with 50 or more employees and, regardless of size, to those subject to EU rules on financial services and anti-money laundering, which includes insurance distribution.
Can an external firm run the channel?
Yes. The law allows the channel to be managed by an external third party that guarantees independence, confidentiality and data protection. The company remains responsible for the system.
Can reports be anonymous?
Yes. The law requires anonymous reports to be accepted and the identity of whistleblowers and the people concerned to be protected.
What deadlines apply?
Acknowledge receipt within 7 calendar days and respond within 3 months, extendable by a further 3 months in especially complex cases.
